Thanks for the clarification John, it does seem there is some conflicting information about depending on which department you look at as in your earlier quote:

"Any car supplied by the Mobility scheme is for the use of the Disabled registered person and not to be used by anyone else unless they are accompanied by the said person."

also from DVLA:

If you are on the Motability Contract Hire scheme in Great Britain, Motability will register and license your vehicle for you. They will hold the Vehicle Registration Certificate for the duration of you contract with them. Motability will also arrange for you car to be taxed annually in the disabled taxation class and will send you your new tax disc. This means that you will no longer need to apply for an exemption certificate in order to tax your vehicle. It is therefore very important that you tell Motability to any changes to your address or circumstances.

NOTE: The “Use” restrictions above also apply if you have a Motability vehicle. Motability intends making it a condition of their scheme that all contract hire vehicles are licensed in the Disabled class. If you feel that you are unable to meet the use restrictions above then you must notify Motability so that the appropriate rate of vehicle excise duty can be paid.

So dispite what motability say in their literature it seems it is down to you to Tax the vehicle if you want to use it for anything outside use on behalf of the disabled person.

The rules on Disabled class exemption apply weather on a motability car or private one.

It won't change my mind about a mobility car though I'd rather have the 75's, how much extra money each month would I have to put to the cost to get something that matches the comfort and luxury our cars provide.

You will never own the car, you end up leasing the car
I also used to receive mobility high rate allowance, and I used to have a brand new car every 3 years

On my first car a Citreon saxo 1.4 sx automatic with nill deposit, You have to get them to service each year, they tax it and you are only allowed so many miles a year

You would be far better off keeping the 75, Getting it put in your wifes name, then getting it registered disabled, You can then get the tax disc paid, Put the allowance away each month to help with the costs of the 75

If you lease a car you have some hard guide lines to stick to, Milages, Any damages on the car has to put right, You have to pay the excess on each bit of damage and not the whole lot together

On my first mobility car, Had a scrach and I damged the rear bumper, another little scarch, I had to pay out the excess for each damage and it ended costing me a lot of money, They inspec the car each year for damage, And if you do not have the repairs done, you will receive letters from them to recover the car back, Stating that you have broken the contract terms

You will never own the car, You times the money what you pay out over the 3 years, You end up paying over 6,240 and never have a thing to show for it

If you receive the Mobility allowance you can at least keep that money and put it towards the costs of the 75 and also get the tax disc paid

Hope she gets the award for high rate but think hard before getting a car on the mobiliy scheme, You might end up regrating it

Once you signed on the dotted line its is a 3 year contact and will be very hard to break or give the car back within that time, They are clamping down a lot on these benefits now and receiving benefits in the future are very hard to get hold off, It was all down to the goverment

If you do not renew with the mobility scheme and your car runs out of tax for a week, They will not send you out a tax disc in the post, This happened to me and I ended up dumping the car a few days earlier, Rather than me paying for the tax for a few days

They were very nasty on the phone

I ended up buying a old banger and got them to tax it, I insured and maintained it, Was still better off because I was receiving the money each week and still had a car to drive

Had a benefit review a couple of years ago and I lost my high rate mobility, I now receive middle care

If I of had the car on the mobility scheme, They would of just taken it back and I would not have a leg to stand on

So many people have abused the benefits system over the years and now they making them very hard to get hold of them

You need a very understanding doctor, consulant to back you up

Had to have a medical under the DWP, And they failed me for benefits, Am now appealing it and this has been going on for months now

Am glad that I brought my 75 and I pay for the insurance and road tax and it costs me £215 a year road tax and £300 a year insurance, BUT I love the 75 and would never be without it

She injured her back lifting him into the rear of her old Escort. The motability car has 2 named drivers on the insurance as sometimes she has to be in the back with my grandson as he may require administration of medicaments during travel. I guess the other 20% of time the car would be used from school to work as obviously you would not drive the child to his school then get a bus.
Many of the parents of disabled kids at his school rely on motability and the school car park could not cope with their cars all day while they bus away. There must be some flexibility on the rules in individual circumstances I guess?
I cannot get hold of her at the moment to check as my grandson is in respite at the moment to give mum a rest and I don't want to ruin her few days of peace and quiet by dropping this on her.
Does any one know what flexibility there is with Motability?? Dave
Dave. looks like wifey will qualify, i am the sort of guy that does his homework, so we are going to see a couple of cars so we can ask questions, as far as dla are concerned, if we got a car then we are paying for it thru the dla award so its ours to use as we see fit (within the norm) so now we off to view some cars ready to make an informed decision and will ask the relevent questions when we get there, regarding tax etc, i think its just a case of changing the cars taxation class and getting your own tax. will let you know later, i know that the free tax is not an option.

been looking round today at the nil advance cars and tbh they are mostly unworkable as they are too small, there is the nissan sqashki but it a small car, the renault scenic tomtom is ok, but i mean ok, the citreon c3 picasso is too small, taking into account the limitations it looks like we will take the money, tbh i never thought about transferring the car into the wifes name to register it as disabled, that leaves the limitations with the tax, but when i went to the citreon dealers and asked them they had never heard of any probs with the limitations, but when i explained what the dvla web site said, i was advised to carry a bottle of paracetemol in the car so i can always claim its being used for the purpose of buying them for the wife, great but how do i explain it when i am in preston and the wife is in blackpool (lol) its dooable and according to honda's motability salesman "its all down to interpretation of the rules", hmmm, these people will tell you any thing.
if i transfer the car into the wifes name then would that affect the insurance, its in my name, can we carry it on that way, also that would mean the car has 1 more former keeper, wouldnt it.

It would add an extra keeper.
Sometimes having the wife as owner and driver on policy can actually reduce it, but depends on your Insurance Company.
Also if the good lady drives don't forget to notify Swansea to prevent problems later.

i have just phoned motability and they said basically, if you have the dla recipients permission and they are happy for you to use it then thats ok, when it comes to the tax and the benefit of the recipient, if it make the recipient "happy" that you are using the car for any reason from getiing yourself a dvd to going to a concert without the recipient, then that is classed as benefitting the recipient to them, i have yet to get thru to dvla to enquire. will post that when i do

ok, just got off the phone to the dvla. they understand that a spouse is going to use the car, they have no problems with that, the spouse may use the car for any reason at all, if the spouse is stopped by the police and it does happen according to the dvla, you will need to explain the situation and they will give you a producer, so there are no problems with the tax either.
