Thanks for the clarification John, it does seem there is some conflicting information about depending on which department you look at as in your earlier quote:
"Any car supplied by the Mobility scheme is for the use of the Disabled registered person and not to be used by anyone else unless they are accompanied by the said person." also from DVLA: If you are on the Motability Contract Hire scheme in Great Britain, Motability will register and license your vehicle for you. They will hold the Vehicle Registration Certificate for the duration of you contract with them. Motability will also arrange for you car to be taxed annually in the disabled taxation class and will send you your new tax disc. This means that you will no longer need to apply for an exemption certificate in order to tax your vehicle. It is therefore very important that you tell Motability to any changes to your address or circumstances. NOTE: The “Use” restrictions above also apply if you have a Motability vehicle. Motability intends making it a condition of their scheme that all contract hire vehicles are licensed in the Disabled class. If you feel that you are unable to meet the use restrictions above then you must notify Motability so that the appropriate rate of vehicle excise duty can be paid. So dispite what motability say in their literature it seems it is down to you to Tax the vehicle if you want to use it for anything outside use on behalf of the disabled person. The rules on Disabled class exemption apply weather on a motability car or private one. It won't change my mind about a mobility car though I'd rather have the 75's, how much extra money each month would I have to put to the cost to get something that matches the comfort and luxury our cars provide. been looking round today at the nil advance cars and tbh they are mostly unworkable as they are too small, there is the nissan sqashki but it a small car, the renault scenic tomtom is ok, but i mean ok, the citreon c3 picasso is too small, taking into account the limitations it looks like we will take the money, tbh i never thought about transferring the car into the wifes name to register it as disabled, that leaves the limitations with the tax, but when i went to the citreon dealers and asked them they had never heard of any probs with the limitations, but when i explained what the dvla web site said, i was advised to carry a bottle of paracetemol in the car so i can always claim its being used for the purpose of buying them for the wife, great but how do i explain it when i am in preston and the wife is in blackpool (lol) its dooable and according to honda's motability salesman "its all down to interpretation of the rules", hmmm, these people will tell you any thing.
if i transfer the car into the wifes name then would that affect the insurance, its in my name, can we carry it on that way, also that would mean the car has 1 more former keeper, wouldnt it. |

It would add an extra keeper.
Sometimes having the wife as owner and driver on policy can actually reduce it, but depends on your Insurance Company. Also if the good lady drives don't forget to notify Swansea to prevent problems later. |

i have just phoned motability and they said basically, if you have the dla recipients permission and they are happy for you to use it then thats ok, when it comes to the tax and the benefit of the recipient, if it make the recipient "happy" that you are using the car for any reason from getiing yourself a dvd to going to a concert without the recipient, then that is classed as benefitting the recipient to them, i have yet to get thru to dvla to enquire. will post that when i do

ok, just got off the phone to the dvla. they understand that a spouse is going to use the car, they have no problems with that, the spouse may use the car for any reason at all, if the spouse is stopped by the police and it does happen according to the dvla, you will need to explain the situation and they will give you a producer, so there are no problems with the tax either.
