That's what causes the problem, a C.O.D. should only be issued when the vehicle is actually broken up.
If it is to be broken up later, the 'Transferred to the Trade' procedure of the V5C should be followed to notify the DVLA that the vehicle has legally been transferred to the the scrap yard, they can then break it up at their leisure, and issue the C.O.D. when they do.
