I would be too, the 1mm across the whole tyre applies to vehicles used before 1933 and vehicles with more than 8 passenger seats, if the central 3/4 of the tyre has more than 1.6mm go back and asked them for a VT17 (appeal form), chances are they will back down and retest it with a pass and maybe an advisory.
