Now looking at the diagram and the Yellow route there seems to be a lot of visibility to the Blue "square". To me either the blue square pulled out just in front of the yellow giving yellow insufficient time to stop or yellow was driving to fast or not paying attention of not intending to stop.

The didn't brake bit of yellow is an issue.

If Blue can not prove speed or driver not paying attention I think it difficult to prove yellow at fault and best outcome I can see is going 50/50 . Any cctv covering the car park?


At what times did op look to his right from the time he started moving until impact? If op did not look right enough times or at appropriate times then oh dear.


anyway I'm sorry for the accident and hope it can be sorted without too much expense

You sir are correct. I just called all surrounding companies which might have some kind of camera footage but to no avail.....

But i did look to my right when i was leaving the parking spot. Her car was NOT in sight so i pulled out.

I know that she was not paying attention because she hit me quite hard.....the fact that she didnt brake is also an indication that she wasnt paying attention (otherwise she would hit the brake and not hit me/hit me but with less damage)

Thats why i mentioned she was driving a little Ford KA. IF she was paying attention there would be no way she could hit me that hard and cause all that damage with such a small car.

However i still somehow have to prove that she was responsible for the crash and not me. And i think my side airbag deploying could be a good indication.

hence my question
