How can that possibly be? If it fails an MOT test at any time then it is unroadworthy and would be illegal to use on the road (apart from returning from the test station)

I can see both sides of the argument here, but why do they advertise you can present for a test up-to 1 month early if a failure results in you being off the road?

From the DVLA website:
Driving a vehicle that’s failed You must not drive the vehicle on the road if it fails the test, even if the MOT hasn’t run out, except to: have the failed defects fixed a pre-arranged MOT test appointment As shown in kc13661's post

Looks like really quite a poor car. The paint looks dreadful in the close-ups, but, I've seen worse. Depends on your plans for it!

I think there is confusion over what is a valid MOT and what is a roadworthy car.
It is my understanding that the original MOT is still valid and would be valid until its expiry date - it is not invalidated by the car subsequently failing a second MOT within the 12 month term of the original. Where the driver would be breaking the law is where the car is unroadworthy. If the driver of this car was stopped they could not possibly be found guilty of not having a valid MOT - but they could be hauled up for having an unroadworthy car. This could be discovered at a spot check - or it could be flagged up when the Police check a vehicle and see that whilst it does have an MOT - the record also shows that it now has faults that make it unroadworthy - as flagged up by a recent MOT the car failed. . |

But as the police mostly work from their ANPR system, if the computer still shows it as having a current MOT them the ANPR system in the police vehicle will ignore it.

I'm sorry but that is child's play compared with what I saw this evening
Well not my 75 at least, but some shocking bodgery revealed, along with some dastardly cover ups How about an ultra low mileage one owner car, presented for it's first MOT, passed after changing a couple of of the original 11 year old tyres. Bought from ebay, and described as........... RARE RARE MODEL 1.8 ENGINE WITH TOP SPEC METALLIC RED -BLACK LEATHER PIPED IN GREY WITH GREY TRIM AND WALNUT FASCIA STEERING WHEEL ETC ALLOYS .-THIS CAR COULD TURN INTO AN APPRECIATING ASSET GIVEN THE MILEAGE OF SIX THOUSAND FIVE HUNDRED -COST APPROX £24000.00 .SUPERB LOOKING CAR- LOOKS BETTER THAN ALL THE JAGUARS CAR HAS NEVER BEEN HAD AN MOT YET AND STILL HAS ORIGINAL BLUE REGISTRATION BOOK. WILL BE SOLD WITH NEW MOT NEW REGISTRATION DOCS UNLESS BUYER WANTS TO STORE AWAY AS INVESTMENT. And what was in store for the unsuspecting new owner........ ....Well how about badly repaired major accident damage, including but not limited to the offside front, both front seat belt pretensioners and driver's airbag had been fired, and crash data in not only the SRS DCU, but the ABS ECU something I've never seen before Hopefully my report will go someway in persuading the vendor (dealer) to refund the unfortunate buyer, but a fresh MOT from not a small outfit either, was no guarantee of a roadworthy vehicle in this case. The instrument pack had been opened up and the SRS warning lamp removed, and judging by the standard of repairs, which were poor, especially to the driver's side A pillar, not to mention the bent chassis leg, it pays to take someone knowledgeable along if parting with a large sum of cash, and not to simply rely upon having an HPI check done There can be no doubt that the vendor of this car was aware of it's previous history, given it was a one owner car Brian |
