I don't believe that is correct. I reckon they could find a reason to slap a Section 59 notice on the driver and take it even if they had insurace.

(Although given the OP is in N.I. the laws may be different over there.)

Does the fixed penalty fine cover any England players who miss a penalty during the World Cup?
