If a new MOT invalidated the old one they wouldn't even need to include a statement about "if your MOT certificate is still valid" under the heading of "Failing the MOT"

Just back from the garage and the car failed on offside front shock absorber leaking. The refusal form VT30/1.0 issued says If you intend to use your vehicle on the road you should have it repaired without delay and have it retested before the existing validity expires. I would like also to know what the law is regarding this subject

If it has failed the mot at 11 months, then it is not in roadworthy condition, by govt standards. Therefore it cannot technically be driven on the road (yet even that is ambiguous, because it seems to suggest it can be driven to be repaired, and also states it can be 'taken away '

my understanding is - if a car is put through an mot and fails it's registered as a fail - you can't argue that it had a pass previously, regardless of expiry date on previous test - however (as long as car is taxed/insured) you are permitted to drive a "reasonable" distance - to take the car home, have repairs done and drive back to have the car re-tested
i'm not sure if an mot tester would have authority to take a car off the road ? i.e something near write-off condition - my car failed my first mot for lambda readings due to a blowing backbox, so not "dangerous" - but if a car was considered undriveable could they impound it ? Paul. |

So is it my understanding that if your car fails on the 11 month and you get stopped , you will get prosecuted for the fault on your car but not for having an invalid mot. Please excuse my take on this if I've got it wrong. ( I'm not the brightest bulb in the pack ) :-)

I think you have got it spot on. And if you repaired the car then you can still see out whatever is left on the old MOT.

So if my car fails on a blown bulb before the renewal date, which I subsequently change with a good spare in the glovebox, can I get stopped for driving on a failed MOT on a roadworthy car (assuming I retest later rather than at the time of swapping the bulb over)?

I looked at this recently as my ex's car failed its MOT, she put it in a month early and despite the fail the database still shows it with a valid / current MOT. |
