Default help needed on clutch issue

Recently upgrade to a 75 cdti after my someone decided the rear of my 600 would look better shaped like the front of a 3 series

bought the car private so no come back im afraid
picked the car up from sunderland and drove it home distance of about 40 miles drove it once more that weekend about 30 miles and then was away at work so car sat for 2 weeks. Came back and there was a slight oil leak which it seems is on the alternator side of the engine .Checked the level in the dipstick and was about 3/4 drove the car a further 30 miles on the friday (took wife to the bingo ) it was her birthday . still small leak but checked level stick almost 3/4 full next day took wife shopping about 30 miles in total but just as i was almost home dropped down from 5th to select 3rd to go round a corner and car would not change into gear
after some messing around managed to get the car into gear and drove it closer to home next had to stop at a t junction so tried to go into first but still wouldnt go once again managed to get in in first and drove it the last 30 yards to home and parked it up turned engine off

1 tried pressing the clutch engine and choosing all gears no problem
2 next started car and tried again wouldn't allow me to change gear
3 noticed that the clutch pedal wasn't fully retracted and pulled it fully up
4 tried to change gear again this time it worked all gears selected with the clutch down no problem
5 checked around clutch pedal for any clutch fluid leaks none detected
6 crawled under car to check for gear box leaks bone dry
7 decided to test the car drive it down and back up the street
8 selected 1st gear no problem but upon releasing the clutch a whining noise can be heard
9 once the clutch is fully depressed it stops and i can drive off

back at work at the moment and will be giving it a proper look this weekend i.e check the level in the master cylinder reservoir just didnt have time this weekend

any info that can be gathered between now and then will be very helpfull

ie theres no grinding noises from the gear box
