Default Tyre sidewall damage - replace or not?

I will probably change this but wanted to get some other thoughts. (it still has good tread)

throw it away and certainly don't drive on it......3 points and up to £2500 fine per tyre I believe if the police take an interest.

Change it before you have a blowout at 70mph. I did a similar thing to a brand new Avon ZZ3 on my ZTT. I went straight round to the tyre fitters and had a new one put on.
