Not police make these decisions 99% of the time, its the Crown Prosecution Service justifying their jobs, and as stated the insurance company will want a prosecution for a payment in these circumstances.

Thanks for all of the advice guys, I have phoned up the Traffic Justice Unit at Lowestoft and have asked for a review of this. But as I am unable to go there and put across my defence they will again go by the Police woman's statement and leave it as is. NO doubt they will say that I could go to court and tell the Magistrate and let them decide. Anyone who has had dealings with Magistrates will know that they are not on your side and will nearly always give the Crown Prosecution Service the benefit of the doubt. Watch this space as I am taking photos of where the incident took place and visit CABs for their opinion

Agree with all the advice, especially to get legal advice which the CAB should be able to help with.
How about a slightly different tack? What do the local media - newspapers etc. say about this apparent wasting of highly valuable Public Funds (The Police & the CPS). The cost to the public purse will already be way over £185. Do you have a Police "tzar" or whatever they are called in your Local Authority. What does your local councillor think of all this? If you do chose to challenge, I would! and it goes so far as a court date (it won't once it passes the auto-sent paperwork and a prosecutor actually has a look at it and realises its tosh) you will be provided with all evidence against you including the report and witness statements. This is a legal requirement under Disclosure. It would be sensible to then seek legal advice as at the moment any solicitor could not address the case against you as you are not in possession of them yet.
There's no way this will pass through the courts. Remember, the court is there for all, it tends to be those that are caught that have the most to say when bad mouthing the justice system. On the whole it's fair and unbiased. Sent from my iPhone using Tapatalk |
