But i did look to my right when i was leaving the parking spot. Her car was NOT in sight so i pulled out. I know that she was not paying attention because she hit me quite hard.....the fact that she didnt brake is also an indication that she wasnt paying attention (otherwise she would hit the brake and not hit me/hit me but with less damage) Thats why i mentioned she was driving a little Ford KA. IF she was paying attention there would be no way she could hit me that hard and cause all that damage with such a small car. However i still somehow have to prove that she was responsible for the crash and not me. And i think my side airbag deploying could be a good indication. hence my question |

What does the other driver say about it?
Our postman had a nice ford mondeo and was hit by a KA the mondeo was a write off and the KA was fine. I would put the KA at fault travelling too fast in a car park and without due care. Any eye witness or cctv? |

If it's as I think, the incident is in Holland then her car will be left hand drive she may have been concentrating too much on the left side if driving fast and not watching to her right..

Hopefully you did make it clear that she hit the rear of your car with the front of hers. I only say this because you've made a point of the side airbag deploying. An insurance monkey might be hearing 'side airbag' = 'side impact': i.e. thinking you were pulling out and she hit the side of your car. Make it absolutely beyond question that you pulled out and only then as you were driving away did she hit you in the rear. For evidence that she didn't brake (or not hard enough) photo's of the scene with a distinct lack of tyre skid marks should suffice. Be prepared for it to not come out 100% in your favour - it never does in the UK.

If your overhead picture is the scene at the time and the silver and the blue cars were as pictured she would not have a clear view until she was in the lane ie had come round the corner. I estimate the distance at which she has full view of your car as about 50 feet- if there were no cars it would be even more. You are moving away from her, so her speed looks to be excessive for her to not have slowed down and avoided the collision. A car park is an area where cars are turning, reversing and other actions and careful drivers take care and it is not sensible to drive at normal highway speeds- if Dutch car parks are anything like British I think you would have a shunt every day if you drove like Ms Ka. Best of luck. Chris.S

As you can see she only hit my rear bumper and rear rim. But she didnt directly hit me from behind because my car was in a small angle. (like in the picture of my first post) Last edited by Mertens34; 10th July 2017 at 20:19.. |

The damage while annoying is not so bad right, is it the wheel that is bent or axle? The bumper isn't so bad, and compared to losing your no claims discount and increased insurance..maybe just fix it and forget it..

-The rear upper suspension arm is bent -The rear shock absorber is bent. -Rear lower suspension arm is possibly bent. -Tire is punctured -Bumper (can be resprayed for 200 euros). -Passenger seat is ripped by the airbag. The problem with my insurance is that they will only pay for the damage on the other car (if im held responsible). However all this isnt even my fault..... im so frustrated right now. Thats why im trying to find a way to prove that she was at fault. |
