Stiffed on my Galaxy engine
I used 1st Choice Spares site to find a donor engine for the wifes Ford Galaxy. Got lots of quotes from breakers who could supply and proceeded to pick one out. I chose WESTCOAST BREAKERS in Preston, an error of magnitude proportion. It will be dispatched on Mon. delivered to you on Tues. he said. So I'm home on Tues. waiting,waiting, didn't turn up. Yes it came on Wed. when I was at work so wifey signs for it. I get home from work, unrapped it and found it to be damaged, (corner part of timming cover plate bent and a hole in the alloy sump case to boot) useless and unusable.
Emailed breakers straight away with the news and attatched photo. Got email back this morning saying the are to contact TNT couriors about the damage. Second email later on stated the TNT are not accepting any liability because, as far as they were concerned my wife had signed for it as good. So I rang the breakers and pointed out that the damage isn't fresh as shown in the pic. and yes, you guessed, not our problem it's been signed for as good. Now the good bit to humour you, I enquired why it was a day late arriving to which I got the reply ? answers on a postcard please. Who can get closest to the answer

They dropped it on the pallet and had no spare pallets...and oh look! There is a hole in it! Sorry to hear you got shafted...

If the outer wrapping of the pallet/package was not damaged then your wife was correct to sign it as good condition. If upon opening the (intact) package you found the contents to be damaged then the suppliers of the package are liable. If the suppliers wish to argue and claim with the carriers who delivered it then that is their choice as they had a contract with them fir delivery. You had no contract with the carriers so don't worry about them. If you were told the engine was good and usable and it has proved to not be then you have a very good case for asking for a replacement engine at no additional cost.

If you paid by credit card, speak to them and get them to do a recharge on the company

I had the same thing on a Peugot gearbox years ago, mate singed for it unwrapped it......mounting sheared off!, they sent a replacement but wrong diff ratio...I had to get at crownwheel and pinion to find out," sorry mate, you have opened it up,so no refund/exchange".Off to CAB,letter/county court threat sale of goods etc..Bingo! money back and did not even collect box!

Thanks for the replies and advice chaps, great as usual. Good effort Zeb on the reason. Apparently it was a day late because it had fallen off the pallet and had to be repackaged by TNT. Still claim that its now my responsabilty because it was signed for. Don't think so, recorded delivery on its way to him tomorrow.
