Any consumer law experts out there?
Story goes...
Last year (December) we ordered & paid for (in full) a 3 piece suite. It wasn't a cheap one either. It was delivered in February this year. It was damaged; one of the motors & a switch was broken. Despite numerous assurances it would be repaired, it wasn't. So, we rejected it. Got some excellent advice from the CAB, and we had our money refunded at Easter time, after 2 months faffing about. We've spoken to the shop, and the manufacturer about collecting it, they say they'll be in touch. No one has contacted us. Over 4 months have passed now. Do 'they' have a time window to collect a defective product, or is it ours legally after a certain amount of time? A work mate has said that if they don't collect it then it's ours to keep - however, I kinda doubt that!

I may be wrong but you may be able to charge storage....think of a figure, let them know formally and you'll be amazed how quickly they will pick it up.

I'm not an expert, but I believe it's something like this:
It's theirs as they've given you your money back. However, it's in your way. I believe you can set them a deadline to collect it, by writing to them. If they fail to do so, I believe then you can take possession. I don't think there's any automatic time limit for it becoming yours. But again, I'm not any kind of expert, just what I'd been led to believe. |

Just out of interest have you checked to see if the manufacturer is still in buisness?
Also I believe if you write them a letter (Recorded delivery) stating they have 30 days to collect the goods otherwise they will be disposed of you will be perfectly fine. At the end of the day you are responsable for the goods until they are collected but the store has a 'reasonable period' to collect the goods. If it's no in the original contract of sale what this period is you have been more than reasonable. If you write to them telling them this reasonable period is about to end and they do nothing then it's not your problem. I bought a bed from Bensons beds. 18 months later one half was making a heck of a lot of noise (yes during intimate moments ). We contacted the companyand they agreed to send out a replacement half which we received about 5 weeks later. Nobody collected the damaged half. I wrote to the company straight away giving them 30 days and then I smashed it up and delivered it to the local tip.. That was 3 years ago and never had an issue.
