The condom does stop the "backsplash squirt" that occurs through the holes in the bottom of the reservoir when the clutch is released, fluid sometimes escaping via the vent hole in the top, if the level is high.

The O ring replaces the seal provided by the condom. The condom when intact, occupies a lot of space in the MC, reducing the fluid charge you can get in there. My theory is that the MC + pipe was pressure filled at the factory, so as to compress the condom, via the pipe joint. Once disturbed, the condom no longer has a purpose other than to provide a seal the lid.

I appreciate there is a breather in the cap, that has to be there to prevent a vacuum or pressure above the fluid. Fluid is more likely to slop out around the sides of the MC reservoir, than via the breather - due to enthusiastic driving, so I ensure they are sealed by the cut condom or as others suggest, an O ring.
