It is regarded as a service item by bmw, but with much longer intervals than the cotton type.

The vortex type has moving parts, and it is for this reason I suspect they became serviceable.from reading bmw forums, these can gum up and stick apparently, though I have not read of complete failures (which I imagine will give same symptoms as a clogged filter).

The vortex types I have fitted don't have any moving parts.

The one I have seen had an internal spring, which I assumed to allow a vent to open once pressure reaches a certain level (within the circular section if I recall, it the section that does not contain the vortex or the filter section as would be in the non vortex version)

I cannot edit my post for some reason.

Here is a link that describes the failure (ignore the ignorance of the yanks on it, the failure is explain at the last post)

Yes that is the depression limiter valve, which closes to ensure the crankcase doesn't go below ambient pressure, but the vortex cartridge itself that replaces the filter has no moving parts.

I replaced the depression limiter diaphragm and spring in my car as I thought it may have been sticking, but it didn't look worn and had done well over 300K miles.
